1. Acceptance of Terms
By accessing or using Tkalam's services, platform, APIs, or any associated software (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Tkalam provides an Arabic dialect translation and localization platform, including text-to-speech (TTS), speech-to-text (STT), and machine translation APIs designed to support Maghrebi and other Arabic dialects. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts and Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to create an account. By registering, you represent that you meet this age requirement.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, national, or international laws or regulations
- Transmit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Infringe any intellectual property rights of Tkalam or any third party
- Attempt to gain unauthorized access to any portion of the Service or its infrastructure
- Use automated tools to scrape, crawl, or extract data beyond permitted API usage limits
- Resell or redistribute the Service without prior written consent
- Engage in any activity that interferes with or disrupts the Service or the servers/networks connected to it
5. API Keys and Usage Limits
Access to the Tkalam API requires a valid API key issued to your account. API keys are confidential and must not be shared publicly. You are responsible for all usage attributed to your API keys. We reserve the right to revoke API keys that are found to be misused or in violation of these Terms.
Your use of the API is subject to the rate limits and quotas specified in your subscription plan. Exceeding these limits may result in throttling, temporary suspension, or additional charges.
6. Fees and Payment
Certain features of the Service are available on a paid subscription basis. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Trial subscriptions are offered at no charge for a limited period. At the end of the trial, your account will be required to transition to a paid plan to continue using the Service.
7. Intellectual Property
The Service and all of its content, features, and functionality — including but not limited to software, text, models, translations, audio, and designs — are owned by Tkalam and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without explicit written permission.
You retain ownership of any content you submit to the Service. By submitting content, you grant Tkalam a non-exclusive, worldwide, royalty-free license to process, transmit, store, and display that content solely for the purpose of providing the Service to you.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TKALAM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TKALAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
10. Termination
We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of competent courts in the jurisdiction where Tkalam is registered.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
